All references to “we”, “us”, “the operator”, or “SellBuy Autos” in these terms refer to the entity above.
Marketplace only
SellBuy Autos connects buyers and sellers. We are not a dealer, broker, or party to any transaction. All sales are directly between users. Any paid plan we offer covers platform services only (account features, listing capacity, seller tools) and never the purchase, sale, escrow, or financing of a vehicle.
Buyer responsibility
Verify registration rules, import duties, insurance, and inspection requirements in the country where the vehicle is located and where you intend to register it. SellBuy Autos does not provide legal or customs advice.
Prohibited listings
- Stolen vehicles or misrepresented title
- Title washing or curbstoning without disclosure
- Fraudulent, misleading, or illegal content
We reserve the right to remove listings and suspend accounts that violate these terms.
Seller responsibilities
You are responsible for the accuracy of listing information, including location, price, and vehicle details. Optional VIN and plate fields must reflect the vehicle offered.
Premium subscription
Premium is an optional monthly, recurring subscription that unlocks platform features such as a higher active listing cap, increased AI photo scan and VIN decode quotas, license-plate blur, and the Premium seller badge. Pricing and the exact feature set are shown on the Pricing page; the same limits and quotas can be inspected on your billing dashboard.
Premium is a digital service. It is not a vehicle, not an inspection, not insurance, and not a guarantee of any sale outcome. We do not hold escrow or process any payment between buyers and sellers.
Billing & auto-renewal
Payments are processed by Stripe Payments Europe, Ltd. as our payment service provider. By starting a subscription, you authorise Stripe to charge your selected payment method for the displayed price each month until you cancel. We never see or store full card details. Invoices are issued in your account name (and, where you provide them, your business legal name, address, and VAT/NIP) under account settings.
Cancellation
You can cancel Premium at any time from /me/billing. After cancellation your subscription remains active until the end of the current paid period and then ends automatically; no further charges are made. Existing listings stay live after downgrade, but you can only add new listings while you are within the Free plan limit.
EU right of withdrawal (14 days)
If you are a consumer in the EU/EEA, you normally have a 14-day right of withdrawal for distance-purchased digital services. By starting Premium and using paid features (e.g. creating listings beyond the Free cap, running AI photo scans or VIN decodes against the Premium quota) you expressly request immediate performance of the service and acknowledge that you lose the right of withdrawal once the service has been fully performed for the period you have paid for. Where the service has only been partly performed, you may be entitled to a pro-rated refund — contact support.
Refunds
Outside the cases above (and any non-waivable consumer rights under the law of your country of residence), Premium fees are non-refundable. We may grant discretionary refunds in cases of duplicate charges, prolonged platform unavailability, or proven billing errors.
Price changes
We may change Premium pricing or the included quotas from time to time. Changes apply to the next billing cycle and we will notify active subscribers by email or in-app at least 14 days before the change takes effect. Continued use of Premium after the effective date is your acceptance of the new price; otherwise, cancel before the next renewal.
Account suspension or closure
If we suspend or terminate your account for breach of these terms (for example, prohibited listings or fraudulent activity), your Premium subscription is cancelled without refund of the current period.
Taxes
The operator is a Polish active VAT taxpayer (czynny podatnik VAT). Prices displayed to consumers on /pricing are gross amounts and include applicable Polish VAT (currently 23%). For EU business customers with a valid EU VAT ID registered in VIES, the reverse-charge mechanism may apply; add your legal name, billing address, and EU VAT ID in account settings to receive a reverse-charge invoice. You remain responsible for any local tax obligations on your side.
Limitation of liability
To the fullest extent permitted by law, SellBuy Autos is not liable for losses arising from transactions between users, vehicle condition, or regulatory compliance in any jurisdiction.
Governing law
These terms are governed by the laws of the Republic of Poland. Disputes are subject to the courts having jurisdiction over the operator’s registered place of business in Kraków, Poland — without prejudice to any consumer protection rules that grant EU/EEA consumers the right to bring proceedings in their country of residence. EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
